The terms under which you may use this website and engage The Review Gap's services. Please read them carefully.
01Acceptance of terms
These terms govern your use of thereviewgap.com (the "site") and any consulting, advisory, or AI review automation services provided by The Review Gap (ABN 60 269 266 445), a sole-trader business operating in Melbourne, Australia ("we", "us", "our").
By using the site, submitting a contact form, or booking a consultation, you agree to be bound by these terms. If you do not agree, please do not use the site or our services.
02About our services
The Review Gap provides AI-powered review and feedback automation services. Our primary offering is a Systems Review consultation, followed (where appropriate) by a formal engagement to design and deploy an automation solution for your business.
The site provides general information about our approach and services. Nothing on the site constitutes a binding offer, a quote, or financial, legal, or business advice. A formal engagement only begins once both parties have signed a written agreement (engagement letter, scope of work, or equivalent).
03Eligibility
You may use this site and engage our services only if you are at least 18 years old and have the legal authority to enter into a contract on behalf of yourself or the business you represent. By using the site, you confirm that you meet these requirements.
04Acceptable use
When using the site, you agree not to:
- Use the site for any unlawful purpose or in any way that could damage, disable, overburden, or impair it.
- Attempt to gain unauthorised access to any part of the site, server infrastructure, or connected systems.
- Use automated tools (other than well-behaved search engine crawlers) to scrape, harvest, or copy content from the site without our written permission.
- Submit false, misleading, or malicious information through any form on the site.
- Misrepresent the nature of an enquiry to obtain a consultation.
05Consultations and bookings
The Systems Review consultation offered through our booking system is a short, exploratory conversation. It is provided without charge and creates no contractual obligation on either party. You may reschedule or cancel at any time using the link in your confirmation email.
We may decline or end a consultation at our discretion — for example, if the conversation is outside our area of expertise, if there is a conflict of interest, or if the booking appears to be made in bad faith.
Any formal engagement that follows a consultation will be governed by a separate written agreement.
06Intellectual property
All content on the site — including text, graphics, the logo and brand mark, the workflow diagrams, the photography, the page structure, and the underlying code — is owned by The Review Gap or used under licence. You may view and share the content for personal, non-commercial purposes. You may not reproduce, modify, distribute, or republish any of it for commercial purposes without our prior written consent.
If we develop or deliver custom work for you under a formal engagement, ownership and licensing of that work will be specified in the relevant engagement agreement.
07Third-party services and links
The site uses or links to third-party services (including HubSpot for meeting bookings, Google Analytics for site analytics, and Netlify for hosting and form processing). These services are governed by their own terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services.
08Disclaimer of warranties
The site and any information provided through it are made available "as is" and "as available", without warranty of any kind, either express or implied, to the extent permitted by law. We do not guarantee that the site will be uninterrupted, error-free, secure, or free from harmful components. Any reliance you place on information from the site is at your own risk.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
09Limitation of liability
To the maximum extent permitted by law, The Review Gap will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the site or our services. Where liability cannot be excluded by law, our total liability to you is limited to the amount you have actually paid us in the twelve (12) months immediately preceding the event giving rise to the claim.
10Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the site, your breach of these terms, or your violation of any applicable law or the rights of any third party.
11Termination and changes
We may suspend or terminate your access to the site at any time, without notice, if we reasonably believe you have breached these terms. We may also modify these terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the site after a change indicates your acceptance of the new terms.
12Governing law and jurisdiction
These terms are governed by the laws of the State of Victoria, Australia. You and we both submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia (Victoria registry) for any dispute arising from these terms or your use of the site.
